Do lawyers get in trouble for lying?

September 4, 2012 The Dispatch runs an article on our case.

In response to this Ms Massucci posts this:
She denies there were ever any settlement offers.  

Her client admits in another article there were offers:

Per Rita Price the author of the dispatch story, Ms Massucci also denied to her that there were any settlement offers; who knows maybe she has Alzheimers.

Don't know about you, but that in my opinion is one big fat lie to say there were no settlement offers!!


And the blows keep coming!! :(

The hardest thing for us (at least for me) was when I would talk about what was happening and I started to hear myself, and I sounded crazy, paranoid.  And people's responses of "how can that happen", "come on that can't happen", "they won't do that, they can't"  made me want to scream at the top of my lungs IT IS HAPPENING TO ME AND I CAN"T DO ANYTHING ABOUT IT!!!

Again case was not completed, and notice her reference to my case.  Just waiting for the judge to affirm it.  And a brave magistrate who followed the law!! Sorry 10th District disagreed, she didn't follow the law!! She was out of jurisdiction.  In my opinion, Ms Massucci wrote the decision!!

We all know how Facebook works, your friends post and then all of that shows up on your timeline.  If there are a lot of comments on a friends post, then it shows up as a top post.  All that posting about the cases that at the time were in front of these Judges?!  Tisk Tisk Although the Ohio board of ethics states that Judges aren't allowed to post comments, it does however say:


In my opinion this would qualify as a reason to remove themselves from the bench.  Completely inappropriate in my opinion for Ms Massucci to be posting about her on going cases while these judges are her friends on Facebook!! 

Now this is really getting good (really sad, if you were on our end)

That name, Lori Brown why does that name sound so familiar.  So I Google her. One interesting article I find.
This has to be a good thing right, ethical teaching for family law practitioners?!

What do you do?

As time progressed through out the case we always felt like if they just heard our side of things they would see this should be thrown out.  If we could produce our evidence then they would see... wouldn't they.  To quote one of my attorney's " its as if they already know which conclusion they wanted to come to".  Where else can all the Bio Mom's be not credible and have all their witnesses be as equally not credible?  Where else can the fact that their is no agreement not matter?  Where else can the waiver of a contract, just be forced upon you?  Where else can someone so stupidly blind to the law, get so far, bully so many people?  Franklin County that is where. 

So what would you do?  File a complaint with the Attorney General's office?!  Great Idea!

OK at least they give us a lead of where we can turn.  Wait, that address looks familiar?!

Holy Smokes, really?!

God led me to Dianne

Maggie had started calling and threatening me that she was going to take me to court.  At the time I was off of work with a broken leg and unable to drive.  I did a google search for attorneys within a reasonable taxi ride from my home.  Many names came up, I don't know why but I emailed one Attorney on the list (Dianne) and called another (can't remember his name).  I recieved an email from Dianne's office stating she was on maternity leave and would not be back for 6 weeks.  I spoke several times with the other attorney's office and was at the point that I would need to pay a retainer and head to their office.  Before this happened I received a phone call from Dianne herself she stated that she would come in to the office and meet with me.  Luckily, she was within a reasonable taxi ride.

You can't know how lucky I feel that my standard was "a reasonable taxi ride away" and I won the jackpot.  Little did we know in that first meeting (Aug 12, 2009) that our lives would become forever changed.

When I say Jackpot I mean Jackpot.  Dianne never quit on us, never focused on what we owed her and never ever compromised on what we wanted.   Even when doing the right thing meant being "shunned" for not following some secret domestic code.  She believes in the law, so for her the law trumped playing nice in the sandbox, the law meant she would fight to make sure the law won.  Make sure that we won!

Below is a text message exchange between Maggie and I regarding the lawsuit and when I found out she was going to file one.  (these were typed out and the phone saved for evidence for the trial)

Aug 3 (this is the day she told me about the lawsuit)

Maggie : I would like to talk about that.  We can compromise

Jen: Before I talk to you I need to think and I need details about what you want.

Maggie: Basically a custody agreement and a schedule

Jen: Send all the details of what your proposing

Maggie: I can’t provide details at this time but I am sure we can work it out



She filed for FULL CUSTODY of my daughter, just to basically get a custody agreement?!!  She wasn't lying!!

If I had fallen for the "I only wanted an agreement" I would have lost my daughter.  If all you want is an agreement, you don't file for full custody!

Am I really reading this correctly!! I can't be.

Despite everything that has been said, the truth is Maggie didn't file for custody of my daughter because she had no choice, she filed, in my opinion, as a means to push her attorney's agenda.  Although the rumor was she only filed for shared custody or visitation, see the truth below.


Clearly as you can see, she sued me for full custody of MY daughter!

People said to me and my family, why didn't Jen just give her time.  Do you know what happens if you don't fight for your rights when someone is filing for full custody of your child?!  What happens is you lose custody! (later you will see that she was offered time, and her attorney refused it)
Pay very close attention to the Magistrate's name on the above document.  Magistrate Hosafras.

WOW!! Looky here, Magistrate Hosafras, oops I mean former Magistrate Hosafras stepped off the bench and went right to work for Massucci and Kline.  Best part check out her subject topic.  Even more astounding, and in my opinion unethical, former Magistrate Hosafras, after having been the original Magistrate assigned to my case, and after having issued visitation time to other legal strangers represented by Massucci and Kline, had the audacity to show up to a hearing representing none other than Maggie Gross.  Does it get any more inappropriate than that?

Luckily (sarcasm) my case changed magistrates, little did I realize nothing said would matter in this court, because in my opinion the court itself was being manipulated.
